BENCZEK Rechtsanwalt has a longstanding experience in assisting clients to make use of, to exploit and to enforce their Intellectual and Industrial Property Rights.

 

The office advises on the use of IP rights against the background of EU rules on the free movement of goods and of EU competition law, including the structuring of licensing agreements. Advising on ‘dual use goods’ in another field in which the office provides services. More recently, the office extended its field of activity into copyright issues relating to Digital Rights Management.

 

In addition to providing its services in the field of IP dispute resolution where conflicts between different signs (including domain names) occur, the office assists clients in enforcing their IP rights before the German courts and in protecting them against counterfeiting and piracy by facilitating the cooperation with customs and prosecution authorities.  

 

Benczek Rechtsanwalt has provided the lead attorney to EU funded projects to adapt the laws of an EU candidate country to the EU acquis and to provide training to rightholders, IP enforcement bodies and to the judiciary in a number of such countries.    

 

Moreover, BENCZEK Rechtsanwalt acted as counsel to a large EU funded database project enhancinganti-counterfeiting and anti-piracy activities by providing a secure plat form for rightholders and enforcement bodies to exchange relevant information.
