Regulatory Counseling

 

Insofar as its regulatory counseling practice is concerned, the office provides advice on regulatory compliance. It also provides regulatory impact analysis to companies affected or potentially affected by current and proposed EU legislation as well as ‘arbitrage’ services to financial investors seeking clarity about investment risks resulting from sector specific or general economic regulation. Further, the office advises on strategies how to use the “tool box” of regulatory remedies in the context of negotiations with companies whose business is subject to a regulatory regime. In addition, the office provides technical assistance to government bodies in EU jurisdictions on regulatory and legislative issues (refer to “technical assistance”).

 

Commercial Law Counseling

 

Insofar as its commercial counseling practice is concerned, the office structures, drafts and revises Intellectual Property licensing agreements with a particular view to ensuring compliance with EU competition rules and rules on the free movement of goods. Based on its longstanding knowledge of the industry, it designs commercial agreements for players in the electronic communications industry (including without limitation agreements on Interconnection, Network Access, Peering, Access to Passive Infrastructure (ducts, co – location), Capacity Lease and Swap, IRU etc.). It also designs the contractual relationships between players in the value chain of Digital Rights Management and in the Media industry against the background of applicable legislation in the field of Intellectual Property, Data Protection and Media.
